Terms of Service
1.0 Introduction
Please read the following Terms and Conditions before using the Service https://oy-atelier.com, which is operated by Øy atelier. This Agreement documents the legally binding terms and conditions attached to the use of the site. Your access to and use of the Service is conditioned on your acceptance of and in compliance with these Terms and Conditions. These Terms apply to all visitors, users and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms you may not access the Service.
1.1 Intellectual property
The Site and all of its original content are the sole property of Øy atelier and are, as such, fully protected by the appropriate copyright and other intellectual property rights laws. All of our products are for personal use only. Under no circumstances should our products be used for commercial use, be distributed or re-produced.
1.2 Currency
All prices on our website is in Euros (€), the customer must refer to their domestic bank’s estimate about what our Euros pricing equals in their currency.
1.3 Purchases and payments
The purchase of any product or service made available through the Service, will require the supply of certain information relevant to your Purchase including, without limitation, your name, address, email address and telephone number. Please refer to 3.0 Privacy Policy stated below for further information. All payments are due upon receipt. If a payment is not received or the payment method is declined, the buyer forfeits the ownership of any item purchases. If no payment is received, no items will be shipped.
The price of each product will be as quoted in our website, except in cases of obvious error. Although we do our best to ensure that all prices listed on the website are accurate, errors may occur. If we find an error in the price of any product you have ordered, we will inform you as soon as possible and give you the option to either reconfirm your order at the correct price or cancel it. If we are unable to contact you, the order will be deemed as cancelled and you will receive a full refund of the amounts you have prepaid.
We are under no obligation to supply you with any product at the incorrect lower price (even after we have sent you a Shipping Confirmation) if the pricing error is obvious and unequivocal and could have reasonably been recognised by you as a mispricing.
2.0 Shipping and Terms of Delivery
We ship worldwide with FedEx from Indonesia. Domestic orders are shipped with GoSend. Orders are shipped within 3-5 business days. No shipments will leave on Saturdays, Sundays or on Indonesian public holidays.

Once the order has been dispatched from Øy atelier’s studio, an e-mail will be sent to the customer notifying him/her of the orders dispatch. The order will be sent to the delivery address that the customer has stated in the registry form- it is important that the customer ensures that address details are correct as these cannot be modified, Øy atelier cannot be held liable for lost orders related to an incorrect address or incomplete information entered on an order.

2.1 Returns & Exchange
Send an email to hallo@oystories.com within 14 days of receiving your purchase. Please state the order number and reason for the return.
Goods must be returned in the same condition as when received with original labels and with trackable delivery to be eligible for return. The customer is fully responsible for the return process including shipping costs. To track the return, customers must refer to the shipping company of their choosing. We recommend using a shipping method with tracking, label the package ‘Return’ and to send the return as a gift to avoid additional import taxes. Once returned to Øy atelier, the item will undergo a quality control check to ensure it has not been worn or damaged. The customer will receive an email when the item has been received at our studio. The right to refund will be applicable if and when the items returned are in the same condition in which they were received by the customer, along with the complete original packaging, tags, labels and any other accessory related to the items. Øy atelier does not refund costs of shipment in case of return or exchange. Any import taxes or customs clearance fees for the return will be covered by the customer and will be subtracted from the total refund amount. Returns and exchanges will not be permitted after 14 days from the date of receipt.
Øy atelier will issue the refund or exchange when the product has been returned in the above-mentioned condition and passed the quality check control. Refunds will be issued within 14 days after the quality control check confirmation email has been sent to the customer.
2.2 Taxes
All orders are shipped worldwide from Indonesia. To make our customers order process as smooth and easy as possible, are all import taxes (VAT) pre-paid by Øy through our shipping partner FedEx and DHL. That means you do not have to pay import tax (VAT) when picking up your Øy piece ordered through oy-atelier.com.
Please note that some countries may add an extra fee for custom clearance and handling that are separate from the import tax. Øy is not responsible for covering these expenses. As Øy is only able to cover the pre-paid import tax, please refer to your governments custom regulations to learn more. All prices on this website exclude shipping costs, which will be added to the total payable amount as described in our Shipping Costs Guide. Prices may change at any time but (except as stated above) eventual changes will not affect orders for which we have already sent you a Shipping Confirmation email.
2.3 Force Majeure
We will not be liable for any failure or delay in performance of any of our obligations under an Agreement that is caused by events outside our reasonable control ("Force Majeure Event"). Force Majeure Events will include any act, event, failure, omission or accident beyond our reasonable control and including the following:
1. Strikes, lockouts or other industrial actions.
2. Civil commotions, riot, invasion, terrorist attack or terrorist threat, war (whether declared or not) or threat or preparation for war
3. Pandemic situation
4. Fire, explosion, storm, flood, earthquake, land subsidence, epidemics or other natural disaster.
5. Inability to use trains, ships, aircrafts, motorised transports or other means of transportation, either public or private.
6. Inability to use of public or private telecommunications systems.
7. Acts, decrees, legislation, regulations or restrictions of any government or public authority.
8. Strike, failures or accidents of maritime, fluvial or postal transportation, or another type of transportation.
Our obligations arising from the Agreement will be suspended during the period in which the Force Majeure Event goes on, and therefore we will be granted a deadline extension for compliance with said obligations for a period of time equivalent to the duration of the Force Majeure Event. We will take all reasonable action to put an end to the Force Majeure Event or to find a solution that allows us to fulfil our obligations under the Agreement despite the existence of the Force Majeure Event.
3.0 Vintage garments
Every one of our vintage pieces has been carefully selected and curated. We strive to guarantee the best quality, however due to the ethereal nature of handmade, vintage and used items, some items may come with minor flaws. The colour and quality of the garments might slightly differ from the photos, even though we do our best providing our customers an honest illustration of the garments state. If any obvious defects occur, it will be described below the ‘Garments state’ heading under ‘Product Information’. However, due to the subjective nature of the words ‘defect’ and ‘flaw’, defects will not be mentioned if we do not consider it a defect or flaw. All vintage and secondhand clothes are worn, which in line with our philosophy ads a patina or a finish that improves the quality and aesthetics of the item. However, if you are critical towards flaws or defects that naturally come with used clothing, we advise you not to use our Service.
When stating that a certain item is vintage, we have assumed that the item was made in a particular year or era where things were done differently, from a time that something of quality was produced or have been kept for several years or worn in a certain way, which has from our point of view improved its condition with an added patina. We do our best to research each item and look for signs that might indicate that it is vintage but we do not guarantee that this information is correct.
4.0 Privacy Policy
Øy stories is committed to providing quality services to our costumers and this document outlines our policies regarding the use and disclosure of Personal Information we receive from users of our Site. We use your Personal Information only for providing and improving the Site. By using the Site you agree to the collection and use of information in accordance with this policy.
4.1 Information we collect
We collect information submitted by you to this Site when you register, contact us or otherwise submit information via the Site. The provision of personal information and data by you is voluntary. If you do not wish for your information to be used for the reasons mentioned below, please do not provide us the information.
4.2 Cookies
By using this website, you agree to our use of cookies. We use cookies to provide you with a great experience and to help our website run effectively. We receive and store certain types of information whenever you interact with us. For example, when you visit our site, our service attaches a small file called a “cookie” to your computer’s hard drive. This enables us to analyse usage patterns in order to tailor it to our costumers preferences. Most web browsers are set to accept cookies, however, you can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. Although, if you do not accept cookies, you may be unable to engage with some parts of our Site.
4.3 What we do with your personal information
The security of your personal information is paramount to us and we will treat such information with care and recognise the need for appropriate protection. Øy stories will not sell, rent or otherwise disclose personal information for any purpose without consent from the user, unless permitted or required by law. Personal information may occasionally be disclosed to certain selected organisations and agents to whom we outsource certain functions and procedures. We will not disclose personal information for marketing purposes to anyone other than the specific organisations unless you have indicated otherwise.
4.4 Why we collect your personal information
We may collect your personal information, including sensitive information for a number of reasons, including; details for shipping online orders and personalised email newsletter information. On occasions, we may conduct contests or competitions that will require the supplying of specific personal information upon entry. In such cases, note that the Privacy Policy may be varied and that the changes will be brought to our users attention in the relevant area of the Site.
5.0 Changes
Øy atelier reserves the right to modify these Terms and Conditions at any time. You will be subject to the Privacy Policies, Terms and Conditions in force at the time you make use of this website or at the time you place an order for products. We therefore ask that you check and review this Agreement for such changes on an occasional basis. Should you not agree to any provision of this Agreement or any changes that are made, we ask and advise that you stop to continue accessing this site. Your decision to continue to visit and make use of the site after such changes have been made constituted your formal acceptance of the new Terms and Conditions.
5.1 Entire agreement
The present Conditions and any other document expressly referred to therein constitute the entire agreement between both parties in respect of the subject of the Agreement and supersede any prior agreement, understanding or arrangement between you and us, orally or in writing.
Both parties hereby acknowledge that they have consented to the execution of the Agreement without reliance on any statement or promise made by the other party or which may be inferred from any statement or written document in negotiations between both parties prior to said Agreement, except for that which is explicitly mentioned in the Terms and Conditions. Neither party will have action in respect of any misrepresentation made by the other party, orally or in writing, prior to the date of the Agreement (except in case of fraudulent misrepresentation), the only action that this party will have is an action for breach of contract in accordance with the provisions of the Terms and Conditions.
